1. License Grant

Subject to your compliance with this Agreement, DevStudio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Applications on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes, and only as permitted by the App Store Terms of Service and this Agreement.

You may not sublicense, sell, resell, transfer, assign, distribute, or otherwise exploit or make available the Applications for any third-party commercial purpose. You may not copy, modify, reverse-engineer, disassemble, decompile, or attempt to derive the source code of any Application.

2. Auto-Renewable Subscriptions

Certain Applications offer premium features through auto-renewable subscription plans managed and processed entirely by Apple through the App Store. By purchasing a subscription, you acknowledge and agree to the following terms.

2.1 Subscription Plans & Pricing

The following subscription options may be available within the Applications. Prices shown are indicative; the actual price displayed at the time of purchase in your local App Store listing is the definitive price and may vary by region.

2.2 Subscription Features

A Premium subscription unlocks enhanced features across applicable Applications, including but not limited to: unlimited usage of core AI/processing features, removal of usage caps, access to exclusive content, priority processing, and ad-free experience. Specific features vary by Application and are described on each App's App Store page.

2.3 Free Trial

Where offered, a free trial period may be available for new subscribers. Your subscription will automatically begin charging at the end of the free trial period unless you cancel at least 24 hours before the trial ends. You will not be charged during the free trial period.

2.4 Billing & Automatic Renewal

Payment is charged to your Apple ID / iTunes account at confirmation of purchase. Your subscription automatically renews at the end of each subscription period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

2.5 Managing & Cancelling Your Subscription

You may manage and cancel your subscription at any time through your Apple ID account settings on your device:

• Go to Settings on your iPhone or iPad.
• Tap your Apple ID name at the top.
• Tap Subscriptions.
• Select the Application subscription and tap Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period. No refunds are provided for unused portions of a subscription period, except as required by applicable law or as determined at Apple's discretion.

2.6 Price Changes

DevStudio reserves the right to change subscription pricing. You will be notified of any price changes in advance in accordance with Apple's policies, and continued use after the price change takes effect constitutes acceptance of the new price.

2.7 Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple through the App Store. DevStudio does not have access to your payment details and cannot issue refunds directly. To request a refund, visit reportaproblem.apple.com.

3. Intellectual Property

The Applications, including all content, features, functionality, source code, graphics, user interfaces, and trademarks, are owned exclusively by DevStudio and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in this Agreement transfers any ownership rights to you. Your use of the Applications grants you no rights in any intellectual property owned or licensed by DevStudio.

4. User Conduct & Prohibited Uses

You agree not to use the Applications to:

• Violate any applicable local, state, national, or international law or regulation.
• Infringe upon the intellectual property rights of others.
• Upload, transmit, or distribute any content that is unlawful, harmful, defamatory, abusive, harassing, obscene, or otherwise objectionable.
• Attempt to gain unauthorized access to any portion of the Applications or any related systems or networks.
• Use automated scripts, bots, or other means to scrape, crawl, or extract data from the Applications.
• Circumvent, disable, or interfere with security-related features of the Applications.
• Use the Applications for any commercial purpose without prior written consent from DevStudio.

5. Privacy Policy

Your use of the Applications is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Please review our Privacy Policy to understand our practices.

By using the Applications, you consent to the collection and use of information as described in our Privacy Policy. In the event of any conflict between this Agreement and the Privacy Policy regarding data practices, the Privacy Policy shall control.

6. Third-Party Services

The Applications may integrate with or link to third-party services, platforms, or content. DevStudio does not control and is not responsible for the availability, accuracy, content, or policies of any third-party services. Your use of third-party services is subject to their respective terms and privacy policies. Specifically:

• Apple App Store: All purchases and subscription billing are governed by the Apple Media Services Terms and Conditions.
• Amazon Web Services (AWS): Background processing services governed by the AWS Customer Agreement.
• AI Providers: Content recommendations in kisskhAI and similar features may rely on AI inference services; these are operated in compliance with applicable provider terms.

7. Disclaimers & Limitation of Liability

THE APPLICATIONS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

DEVSTUDIO DOES NOT WARRANT THAT: (A) THE APPLICATIONS WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME; (B) ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE APPLICATIONS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE APPLICATIONS WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVSTUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES — WHETHER INCURRED DIRECTLY OR INDIRECTLY — OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APPLICATIONS.

IN NO EVENT WILL DEVSTUDIO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNTS YOU HAVE PAID TO DEVSTUDIO IN THE PAST TWELVE (12) MONTHS FOR THE APPLICABLE APPLICATION, OR FIFTY DOLLARS ($50) IF YOU HAVE NOT HAD ANY SUCH PAYMENT OBLIGATIONS, AS APPLICABLE.

8. Indemnification

You agree to defend, indemnify, and hold harmless DevStudio and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement or your use of the Applications, including, but not limited to, any use of the Applications' content, services, and products other than as expressly authorized in this Agreement.

9. Termination

DevStudio reserves the right to suspend or terminate your access to the Applications at any time, with or without cause or notice. Upon termination, your license to use the Applications immediately ceases. Provisions of this Agreement that by their nature should survive termination — including intellectual property rights, disclaimers, indemnification, and limitations of liability — shall survive.

You may terminate this Agreement at any time by deleting the Applications from all of your devices and cancelling any active subscriptions through your Apple ID account settings.

10. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Virginia for the resolution of any disputes.

Any dispute, claim, or controversy arising out of or relating to this Agreement that cannot be resolved informally shall first be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Virginia, and judgment on the award may be entered in any court having jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.

11. Apple-Specific Terms

The following terms apply specifically to Applications downloaded from the Apple App Store:

• Acknowledgement: You acknowledge that this Agreement is between you and DevStudio only, and not with Apple, Inc. Apple is not responsible for the Applications or their content.
• Scope of License: The license granted to you is limited to a non-transferable license to use the Applications on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
• Maintenance and Support: DevStudio is solely responsible for providing maintenance and support services for the Applications. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Applications.
• Warranty: In the event of any failure of an Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Applications.
• Product Claims: DevStudio, not Apple, is responsible for addressing any claims by you or any third party relating to the Applications or your possession and/or use of them, including product liability claims, consumer protection claims, intellectual property infringement claims, and any claim under applicable law.
• Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

12. Changes to These Terms

DevStudio reserves the right to update or modify this Agreement at any time. We will provide notice of material changes by updating the "Effective Date" at the top of this page and, where appropriate, through in-app notification. Your continued use of the Applications after any such changes constitutes your acceptance of the new terms. If you do not agree to the updated terms, you must stop using the Applications and cancel any active subscriptions.

13. Severability & Entire Agreement

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The failure of DevStudio to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

This Agreement, together with the Privacy Policy and any other legal notices published by DevStudio within the Applications, constitutes the entire agreement between you and DevStudio concerning the Applications and supersedes all prior agreements and understandings, whether written or oral.
